Back to Normal

Still excited about the ERDC win a couple of pasts now back. But still drawing things. I’m working in black and white, because I’ve got an upcoming gig, and want to be sure I can handle it with aplomb. So, it takes a little practice for me to “get back in the groove.”

Happily, it’s been a pleasant last few days, so opportunities for sketching outdoors. Like that guy up above. The pic below is one of the species of swamp greaser. Where he came from in my head, I’ll never know:

Drink and Draw

Spent an interesting evening at the Drink and Draw at the Casa del Popolo. Not many people there, but we were a happy table. I had to relax a bit before I could really draw stuff, hence the exercise above. Later I drew this hipster guy, who is a little more legible:

GREAT NEWS: Montreal Freelance Writers Win Authorization in Electronic Rights Class Action

This something exciting which I’ve been sitting on. But the embargo is over, so i can tell you about it now. Background on the court case here: http://erdc.ca, (UPDATE: and check “News and Announcements” for an impromptu history of the action thus far.) It’s taken us about 12 years to get to this step (one of the other side’s tactics was to delay, and we’ve had our own setbacks on our side). This is “authorization,” which means the Quebec Supreme court recognises that we have a case. Now it can go to trial.

It’s an historic time for Canadian freelancers!

QUEBEC SUPERIOR COURT JUDGE GIVES GREEN LIGHT TO CLASS ACTION OVER ELECTRONIC REPRODUCTION RIGHTS

After more than a decade, the Electronic Rights Defence Committee (ERDC) has received authorization from Quebec Superior Court to proceed with a class action suit against some of the biggest names in Canadian media.

At issue is electronic use without permission or compensation for work by freelance writers in The Montreal Gazette. The defendants are the Montreal Gazette Group, CanWest Global Communications, Hollinger Canadian Publishing Holdings, CanWest Interactive, Southam and Southam Business Communications, Infomart Dialog and Cedrom-SNI.

In February 2008, the Honourable Eva Petras, J.S.C., heard three days of arguments from Mireille Goulet – the ERDC lawyer, and a team of lawyers representing the defendants. The Justice’s decision was rendered March 31, 2009. It authorizes the ERDC to institute class action proceedings with writer and translator David Homel as its official designated member. The class action group includes all freelance writers whose articles, originally published in The Gazette, have been allegedly illegally reproduced on the Infomart data base since 1984.

The next steps will lead toward a trial on the merits of the case, a process which may take several years to reach a conclusion.

The ERDC case is one of several in North America seeking compensation for unauthorized electronic use of freelance writers’ work. In October 2007, the Canadian Supreme Court ruled five to four in the Heather Robertson vs. Thomson case that freelancers do indeed hold copyright on their work reproduced in electronic data bases. The US$ 18-million class action settlement in the United States which followed from the Tasini vs. New York Times case is currently before the US Supreme Court, which has agreed to decide whether a lower court has jurisdiction to approve settlement agreements. The Association des journalistes indépendants du Québec (AJIQ) is also currently in the process of undertaking a class action against several Quebec media providers.

Boring Old Men

Mainly painting boring [pointing] old men in suits. Don’t know why I do these. They’re not for entertainment. They’re just what come out, instead of women in bikinis and such-like. Anyhow, I’m having fun with my new dreary paint colour. It’s mainly sort of a zen exercise for me.

But perhaps I’ll get onto something meaningful sometime. I’m writing lots of little stories and jokes in my book. Trouble is, it takes a lot of effort for me to do them. I’m happier just dicking around this way.

Back to Colour

Reported in an earlier post that the Art-Tec store had gone out of business and was having a sale. I saw the building while going by in a bus, taking my cat to the vet (it was to get her stitches out from spaying surgery: very successful). But the store was sad: all of the banners and signs plastered with these garish fluorescent “everything must go” stickers.

I went there the other day. I’d been avoiding going, because I Knew I was going to feel like a vulture. I remember the same thing when a beloved bookstore closed on Duluth Street many years ago. The owner was behind his counter in a rapidly emptying store, a long line of customers buying heavily discounted books. “Looks like I found the price point!” he said ruefully, or words to that effect.

But I am a poor artist type, and was tempted by the idea of cheap paints and nice sketch books. So, yesterday, after finishing the sketch of my neighbour’s bike up above, I got on my own bike and went.

Sadly, the gentle old guy I used to deal with, and his young student employees were gone. Just staff there from the re-possessors, who didn’t know art materials. I got there too late, so most of the good stuff was gone (they were selling the fixtures). And the discounts weren’t all that spectacular. Just 30% off the regular price.

But I did pick up a tube of “Mars Violet,” which is a yucky colour — sort of a reddish purple. Still great for underpainting, and also doing paintings of vaguely sickly, evil things. Like this storybook tower down below:

Okay, I admit it. I’m a terrible nerd. I’ve been watching my “Lord of the Rings” DVDs again.

Another Big Whack of Drawings

More faces, this time drawn with fellow artist and bon vivant Rick Gagnon, during our weekly soirée at the Cock N’ Bull bar. Above it’s my worst enemy, the phony film director guy who wants me to work for him for no money. He’s not at all like the real directors I know, who actually make films.

Rick had brought a book of War Comics with him, so business guy below got a prison camp background. Slave labour is good business sense!

Two bar characters. The guy in front looked different when I drew him. Now he looks like Tom Hanks. But that’s the kind of thing that happens when you’ve got another hand interpreting your scribbles:

I love the impression of “Tony” the colourful busboy guy, in behind. Rick skipped his pen early on, making that stroke across Tony’s forehead. He wanted to make it into a sombrero, but I think that would have been tragic. Great blacks spotted in this pic as well. I’m still learned how to add the blacks.

Sadly, Rick will be in New York next week, slumming and having drinks with Dirty Danny Hellman, while I starve away back here in Montreal. So, no Gagnon Fridays next week. I’ll have to work my own drawings for a while.

Further Monster Cats, and Things.

You’d think it would be easier, painting two pictures on the same piece of paper at the same time. Saves effort stretching it, and all that. But it’s too easy to splatter dark blobs of paint around, and therefore not worth it.

I’m sad that the scanner took out all the delicate gradations of tone in the first picture, and dropped out a lot of the blue altogether.

Alarming Alien Cats

The “They Live!” alien family who put up the lost cat poster in yesterday’s drawing got their pet back. This has made their gruesome little daughter especially happy.

When they’re not telling earth people to “OBEY” and “CONSUME,” this couple collects cats from different worlds. Below, the “Alien ™” cat has forged an alliance with the earth kitty. But there may be some blood (or molecular acid plasma) spilled over who gets to play with the tinkle ball!
